THIRD AMENDMENT OF THE DECISION OF DIRECTOR GENERAL OF CUSTOMS AND EXCISE
No. 205/BC/2003
ABOUT IMPLEMENTATION GUIDELINES OF PROCEDURES AND
SUPERVISION OF IMPORTATION GOODS FOR EXPORT PURPOSE

DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

• a. whereas to increase export of non-oil and gas then it is considered necessary to moderate the procedures of the facilitation of importation goods for export purpose;
• b. whereas to improve the service by utilizing integrated electronic system then it is considered necessary to moderate the procedures of the facilitation of importation goods for export purpose;
• c. Whereas based on consideration as referred to in letter a and b above, then it is need to make third amendment of the decision of Director General of Customs and Excise No. 205/BC/2003 about Implementation Guidelines of Procedures and Supervision of Importation goods for export purpose.

In view of:

• 1. Presidential Decree No. 45/M/2006
• 2. Decision of The Minister of Finance No. 580/KMK04/2003 about Procedures and Supervision of Importation goods for export purpose as amended by Regulation of Finance Minister No. 36/ PMK94/2005;
• 3. Decision of Director General of Customs and Excise No. 205/ BC/2003 about Implementation Guidelines of Procedures and Supervision of Importation goods for export purpose as last amended by Regulation of Directorate General of Customs and Excise No. P-25/BC/2005.

DECIDES

To stipulate :

REGULATION OF DIRECTORATE GENERAL OF CUSTOMS AND EXCISE ABOUT THE THIRD AMENDMENT OF THE DECISION OF DIRECTOR GENERAL OF CUSTOMS AND EXCISE No. 205/ BC/2003 ABOUT IMPLEMENTATION GUIDELINES OF PROCEDURES AND SUPERVISION OF IMPORTATION GOODS FOR EXPORT PURPOSE.

Article 1

Decision of Director General of Customs and Excise No. 205/BC/2003 about Implementation Guidelines of Procedures and Supervision of Importation goods for export purpose is amended so that overall of the decision shall be as follow:

1. Provision of Article 35 paragraph (2) is changed so that Article 35 shall be as follows:

" Article 35

(1) Application of Return shall be submitted to Chief of Region and enclosed with:

• a. Report of Goods Usage and/or Import Material which Asked for Return (BCL.KT02); and
• b. SSB.

(2) Besides the enclosure as referred to in paragraph (1) point a and b, the application shall be enclosed with:

• a. For Export Goods:
• 1. Import or delivery document of Bonded warehouse shall be in the form:
• a) Copy of PIB/PIBT/BC 25/PPKP which has got SPPB/SPPB-KB/approval which issued by functionary. In the event of the applied of PDE system, the approval shall be issued from functionary shall be replaceable with recording of SPPB data from computer which change the status of PIB from gate becomes output goods which memorize in PIB data base;
• b) Third sheet/SSPCP of original SSBC;
• 2. Document export shall be in the form
• a) Copy of PEB which already get Export Approval by Functionary;
• b) Original LPBC/ LHP;
• c) Copy of B/L or AWB or of other equal document of transportation document
• b. For goods which are delivered to Bonded Warehouse shall be enclosed with:
• 1. Import or delivery document of Bonded warehouse shall be in the form:
• a) Copy of PIB/PIBT/ PPKP which has got SPPB/approval which Issued by Functionary;
• b) Third sheet of original SSBC/SSPCP;
• 2. Delivery document of Bonded warehouse shall be in the form:
• a) BC 2.4;
• b) Copy of Invoice and Tax Invoice;
• c) SPPB-KB;
• d) Purchase Order;
• e) Copy of sales contract to Bonded warehouse. "

2. Change the Enclosure X point A of The Decision of Director General of Customs and Excise No. 205/BC/2003.

Article 2

This Director General Regulation shall take effect as from the date of stipulation.

For everyone to take cognizance thereof, this Director General Regulation shall be promulgated by placing it in State Gazette of the Republic of Indonesia.
